Terms of Service and Release of Liability

PARTIES, ACCEPTANCE OF TERMS OF USE

Hunting Poodle Marketing, LLC. (dba “15MinKettlebells.com” or “Company”) is a health & fitness content creator that creates and delivers instructional audio and video content (the, “Content”) for personal consumption on an online subscription basis, principally through the website “15MINUTEKETTLEBELLS.COM”, and maintains its principal place of business at 55 Monument Circle, suite 350, Indianapolis IN 46204. You (“Member” or “You”), desire to obtain health & fitness instruction from 15Min. These Terms of Service and Release of Liability is entered into by and between You and 15MinuteKettlebells.com.

The following terms and conditions, together with any documents they expressly incorporate by reference (collectively, "Terms of Use"), govern your access to and use of www.15minutekettlebells.com (the, “Website”), including any content, functionality, and services offered on or through the Website, whether as a guest or a registered user. Please read the Terms of Use carefully before using the Service or Website. By using the Website, or by clicking to accept or agree to the Terms of Use when this option is made available to you, you accept and agree to be bound and abide by these Terms of Use. 3. Subscription and Fees

Some portions of our Services may require a membership subscription or one-time payment, to access. Membership plans and pricing are provided on the Website. By subscribing, you authorize us to charge your selected payment method at the time of purchase and for all subsequent renewal periods. We reserve the right to change pricing and subscription terms with prior notice. Members will be notified at least sixty (60) days before of any change of subscription rate or terms. Subscriptions will renew automatically unless canceled before any subsequent renewal date. All payments are non-refundable unless otherwise stated.

4. Health and Safety

The Services are provided for general fitness purposes You acknowledge that strength training involves inherent risks, including but not limited to muscle strains, sprains, fractures, or other personal injuries. You agree to consult with a physician before beginning any new exercise program, particularly if you have a history of health conditions or injuries. You understand and accept full responsibility for your use of the Services and any associated risks.

5. Use of Kettlebells

The instructional strength training content focuses on kettlebell exercises. While they are uniquely effective training tools, kettlebells are not safe. If you are not careful, you will get hurt. If you are careful, you may still get hurt. Use weight progressions in your training starting with a lighter weight than you think you need. Practice technique and be careful. You acknowledge that engaging in physical activity involves inherent risks and assume full responsibility for any injuries or damages. You agree that should you get hurt, 15Min has NO Liability.

6. Assumption of Risk & Liability Disclaimer

By using our Services, you acknowledge and accept that strength training, including kettlebell exercises, carries inherent risks of injury. You assume full responsibility for any injuries or damages resulting from participation in any exercises demonstrated in our Content. The Company, its affiliates, officers, employees, and instructors are not responsible for any injuries, health complications, or other damages arising from the use of our Services. Our content is for informational purposes only and should not be considered a substitute for professional training or medical advice.

7. User Conduct

Members receive access to exercise videos, programs, and related content, with registered user account credentials. The Content is provided for personal, non-commercial use only. We reserve the right to revise, amend, or withdraw this Website, and any Services or Content we provide on the Website, in our sole discretion without notice. We will not be liable for damages if, for any reason, all or any part of the Website is unavailable at any time or for any period. From time to time, we may restrict access to some parts of the Website, or the entire Website, to users, including registered users.

MEMBER ACKNOWLEDGES THAT SHE/HE HAS CAREFULLY READ THIS PARAGRAPH AND FULLY UNDERSTANDS THAT THIS IS A WAIVER AND RELEASE OF LIABILITY, EXPRESSLY WAIVING HER/HIS RIGHTS AND THE RIGHTS OF ANY OF HER/HIS HEIRS, LEGAL REPRESENTATIVES AND ASSIGNS, TO SUE OR OTHERWISE SEEK DAMAGES OF ANY KIND FROM THE COMPANY, ITS OFFICERS, EMPLOYEES, OR AGENTS, FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES RESULTING FROM YOUR USE OF COMPANY SERVICES, REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT, OR OTHERWISE.

In no event will the collective liability of the company and its subsidiaries, affiliates, service providers, employees, agents, officers, and directors, to any party (regardless of the form of action, whether in contract, tort, or otherwise) exceed the greater of $27 or the amount you have paid to the company for the applicable products and services in the last three (3) months out of which the claimed liability arose.
